SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?

When you sign up or subscribe to any of Cyanea Technologies’ plans, as part of the buying and selling process, Cyanea Technologies collects personal information from you such as your name, address, and email address. Cyanea Technologies also automatically receives your computer’s internet protocol (IP) address that helps provide it with relevant information pertaining to your browser and operating system.

All the data collected from you and your Cyanea Technologies voicebots is owned by you completely. Cyanea Technologies has absolutely no ownership over it.

SECTION 2 – CONSENT

Cyanea Technologies provides conversational bots and related AI Services as a service (“Service”).

Subject to your compliance with the Terms of Service and solely during the subscription term of your account, you have the limited right to access and use the Service in accordance with the service plan(s) that you subscribe to for your internal business purposes. Without limiting the foregoing, your right to access and use the Site is also subject to the restrictions and policies implemented by Cyanea Technologies from time to time. You must be 18 years or older to use the Service.

How do you get my consent?

When you provide Cyanea Technologies with personal/financial information to sign up or purchase a plan, this implies that you consent to it collecting this information and using it for that specific purpose only.

How do I withdraw my consent?

If after you opt in, you change your mind, you may withdraw your consent for Cyanea Technologies to contact you or retain your information at any time, by emailing Cyanea Technologies at info@cyanea.ai.

SECTION 3 – CLIENT AND VOICEBOT USER DATA

The information Cyanea Technologies receives from its Clients and the client’s voicebot users is handled in different ways. Please find the details below.

3.1 - Cyanea Technologies Clients

A. Information collected directly from the client:

As a client of Cyanea Technologies, information is collected relating to you and your use of our services from a variety of sources including registration information, voicebot metadata, conversation recordings, plan & billing info.

Cyanea Technologies may also collect your personal information or data if you submit it through other means for a different context. For example, if you write a testimonial.

B. Information Cyanea Technologies collects about a client indirectly or passively through other forms of interaction:

Cyanea Technologies may also collect your usage, device, application and referral data including but not limited to call session data, IP address, browser type, geographic location, referred source etc.

Cyanea Technologies may also collect personal information or data from third parties if the client permits those third parties to share such information.

Cyanea Technologies also uses third-party tracking services that employ cookies and collect aggregated and anonymized data about visitors. This data can include usage and user statistics, among other types of data.

3.2 – Cyanea Technologies' Clients Voicebot Users

As a voicebot user, when you respond to conversational agents hosted by Cyanea Technologies on behalf of its clients and upon their instructions, Cyanea Technologies collects information relating to you and your use of our services from a variety of sources:

A. Information collected directly from the voicebot user:

Cyanea Technologies collects and stores the voicebot’s responses and dialogue transcripts from the voicebot user. Since the Cyanea Technologies client is usually the same entity that invited the voicebot user to interact with the system, that client is responsible for the data and manages it.

Note: Cyanea Technologies is not responsible for any content of its clients' voicebots and does not manage their bots or data.

B. Information Cyanea Technologies collects about voicebot users from other sources:

Cyanea Technologies may also collect your usage, device, application, IP address, browser type, geographic location, referred source etc.

Cyanea Technologies also uses third-party tracking services that employ cookies and collect aggregated and anonymized data about visitors. This data can include usage and user statistics, among other types of data.

Cyanea Technologies also collects email addresses & phone numbers of the voicebot users if the client adds an email/mobile question to their voice flows. The voicebot user may choose to not give their email/mobile when having a conversation with the agents configured by clients using Cyanea Technologies.

3.3 – Data Retention

Cyanea Technologies has your data backed up for seven days. Any requests to get your data back in case of bot deletion can only be processed within the next 7 days. No requests will be allowed past the 7-day period, as all data will permanently be deleted from our data centers.

SECTION 4 – PURPOSES OF THE USE AND SHARE OF CLIENT AND VOICEBOT USER INFORMATION/DATA

Cyanea Technologies uses the information we collect from you to perform the services agreed upon, described in the Terms of Use.

Internally, Cyanea Technologies may also perform statistical and other analysis on information collected to measure user behavior and trends, to monitor, troubleshoot, and improve its services and to plan for new features.

Cyanea Technologies may use your information for internal purposes designed to keep its services secure and operational, such as for testing purposes, troubleshooting, to prevent abusive activity (i.e. fraud, spam, phishing activities), and for service improvement, research, and development purposes.

Cyanea Technologies also collects your data to answer your questions and provide you with system tips and updates.

Cyanea Technologies does not sell your voicebot data to third parties without your permission. Cyanea Technologies can share your information with its service providers upon consent from you, in which case those third parties are required to comply with this privacy policy and any other adequate technical and organizational measures. Cyanea Technologies contractually binds these service providers to keep your information confidential and to use it only for the purpose of providing these services.

Your data is not disclosed to any third party except:

• For providing the services you requested and for which Cyanea Technologies collaborates with third parties,
• When you give explicit permission,
• When it is required by a competent authority in the exercise of its duties (for example in order to investigate, prevent, or take action regarding illegal activities), or
• As otherwise required by law.

Cyanea Technologies does not use your voicebot data other than as described in this Privacy Policy and the Terms of Use.

If the ownership of Cyanea Technologies changes or Cyanea Technologies undergoes a corporate reorganization (including a merger or consolidation), or any other action or transfer between Cyanea Technologies entities, you expressly consent to Cyanea Technologies transferring your information to the new owner or successor entity so that the services agreed upon can be continued.

SECTION 5 – PAYMENT

Cyanea Technologies does not store your card data on its servers. The data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS) when processing payment. Your purchase transaction data is only used as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is not saved.

SECTION 6 – THIRD-PARTY SERVICES

In general, any third-party providers used by Cyanea Technologies will only collect, use and disclose your information to the extent necessary to allow them to perform agreed upon services.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information provided to them for purchase-related transactions.

For these providers, Cyanea Technologies recommends that you read their privacy policies, so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than you. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave Cyanea Technologies’ website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or Cyanea Technologies’ Terms of Service.

SECTION 7 – SECURITY

To protect your personal information, Cyanea Technologies takes careful precautions and follows the best industry practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

SECTION 8 – COOKIES

If you prefer not to accept cookies or otherwise wish to disable Cyanea Technologies’ use of tracking technologies, most browsers and mobile devices allow you to change your settings to notify you when you receive cookies or when other tracking technologies are being used, and to choose whether to accept/allow it. Most browsers also allow you to disable or delete existing cookies or to automatically reject future cookies. Disabling cookies may limit your ability to use Cyanea Technologies’ services.

Certain tracking technologies Cyanea Technologies uses are related to advertising networks, and through those technologies Cyanea Technologies may share certain information such as IP addresses. No personally identifiable information is shared with these advertising networks, but please note that the information shared with those advertising networks might be combined with other information about you that those networks may have collected from other sources.

You must not modify, adapt or hack the service or modify another website to falsely imply that it is associated with any Cyanea Technologies service.

SECTION 9 – AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence.

SECTION 10 – CHANGES TO THIS PRIVACY POLICY

Cyanea Technologies reserves the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If material changes are made to this policy, Cyanea Technologies will notify you that it has been updated, so that you are aware.

Software License

Any software available for download via the Site is the copyrighted work of Cyanea Technologies and/or its licensors. Use of such software is governed by the terms of the end user license agreement that accompanies or is included with the software. Downloading, installing, and/or using any such software indicates your acceptance of the terms of the end user license agreement.
